The client is under the duty to pay all notarial costs and fees. The rules are fixed in the so called German Kostenordnung, which applies to the whole of Germany. Unlike when dealing with al solicitor / lawyer it is not possible to arrange a fee with a notary.

When purchasing a property, the purchaser has to pay the property acquisition tax (4,5 % in Berlin and Hamburg; 3,5 % anywhere else in Germany), the fee for the real estate agent (between 4 und 7 %) and the costs of the financing.

The vendor is under the obligation to amend the Land Register entry.
